    Why is Trademark Registration important for my brand?

    Trademark registration grants you exclusive legal ownership and rights to your brand name, logo, or slogan in relation to the goods/services you offer. It prevents competitors from using identical or deceptively similar marks, helps build distinct brand value & customer trust, allows you to legally use the ® symbol, and provides a strong legal basis to sue for infringement if someone copies your brand identity. It's a crucial asset for any business.

    What is the difference between Trademark (™) and Registered Trademark (®) symbols?

    You can use the ™ (Trademark) symbol next to your brand name or logo to indicate that you claim it as your trademark, even if it's not officially registered or while the application is pending. This shows your intent to use it as a brand. The ® (Registered) symbol can *only* be used after your trademark has been officially registered with the Trademark Registry and the registration certificate has been issued. Using the ® symbol without a valid registration is illegal and can lead to penalties.

    How long does IP protection typically last in India?

    The duration varies by IP type: Trademarks are initially registered for 10 years and can be renewed indefinitely for subsequent 10-year periods. Copyright in India generally lasts for the author's lifetime plus 60 years after their death. Patents are granted for 20 years from the filing date and are non-renewable (maintenance fees apply). Industrial Designs are protected for 10 years from the registration date, renewable once for an additional 5 years.

    What kind of works can be protected by Copyright?

    Copyright protects original expressions of ideas, not the ideas themselves. Common works eligible for copyright protection in India include: Literary works (books, articles, scripts, website content, software source code, databases), Artistic works (paintings, drawings, photographs, logos, sculptures, architectural designs, label designs), Musical works (compositions, lyrics), Sound recordings (audio recordings), and Cinematograph films (videos, movies).

    What is a Design Registration and how is it different from Trademark/Copyright?

    Design Registration protects the unique aesthetic features (shape, configuration, pattern, ornament, or composition of lines or colors) of an article that appeal to the eye. It does not protect the functional aspect. A Trademark protects brand identity (name, logo). Copyright protects original literary/artistic expressions. For example, the unique shape of a bottle can be design registered, its brand name trademarked, and the label artwork copyrighted.
